360 Photo Pop — Terms & Conditions

These Terms & Conditions ("Terms") govern all bookings and services provided by 360 Photo Pop ("Company," "we," "us," or "our") to the person or organization booking our services ("Client," "you," or "your"). By booking, paying a deposit or invoice, or otherwise engaging our services, you agree to these Terms.

Our services include our 360-degree video photo booth rental and Polaroid Event Photography, together with any add-ons selected at the time of booking ("Services"). We are based in Boise, Idaho and serve the Treasure Valley and surrounding areas.

1. Booking & Deposit

Your date is reserved only once (a) your booking details are submitted and (b) the required payment or deposit is received. Dates are not held until then.

A non-refundable deposit of $150 is due at booking to reserve your date and is applied toward your total. Dates are not held until the deposit is received.

2. Payment

The remaining balance is due [7 days before] the event unless otherwise agreed in writing. Bookings may be paid through our website or by invoice. For corporate, institutional, or purchase-order Clients, payment terms will follow the applicable signed contract or invoice.

If the balance is not received by the due date, we may treat the booking as cancelled under Section 4 and are not obligated to perform the Services until payment is made.

3. Additional Fees

The following fees apply where relevant and will be reflected in your quote or invoice:

  • Travel: If total travel mileage within the Treasure Valley exceeds 50 miles, a $50 fee applies. For events outside Boise, Eagle, Meridian, Nampa, Caldwell, Middleton, and Kuna, a fee of $50 per hour of travel time applies.

  • Late-night: Events starting after 11:00 PM MST incur a $150 fee.

  • Holiday: Events held on holidays (such as Christmas Eve, New Year's Eve, or Independence Day) incur a $200 fee.

  • Overtime: Additional operating time, if we can accommodate it, is billed at $100 per hour, arranged in advance where possible.

  • Add-ons: Optional add-ons range from $30–$100 (event props, vertical fog machine, bubble guns, money gun) plus extra time at $100/hour and custom branded signage (price varies).

4. Cancellation & Rescheduling

By Client. If you cancel, your $150 deposit is non-refundable. Any additional amounts already paid toward the balance will be refunded.

Rescheduling. You may reschedule once, subject to our availability, with reasonable advance notice; your deposit transfers to the new date.

By Company. If we must cancel for reasons within our control, you will receive a full refund of all amounts paid, including the deposit. This is our sole obligation in that event.

5. Client Responsibilities

To set up and operate safely and as promised, the Client agrees to provide, at no cost to us:

  • Space: A flat 10' x 10' area for the 360 platform and any selected add-ons, plus room for guests.

  • Surface: A firm, level surface. For outdoor events, a hard surface is required (see Section 7).

  • Power: Access to a standard grounded electrical outlet near the setup area.

  • Access: Venue access for load-in beginning at least 30 minutes before the Service start time, and for teardown afterward.

Delays or limitations caused by the venue or Client (late access, insufficient space, or lack of power) that reduce our operating time will not extend the Service time or reduce the fee.

6. Service Time & Setup

The standard 360 photo booth package includes 2 hours of active booth time with an attendant. Our team arrives approximately 20–30 minutes before the start time for setup, and setup and teardown are handled by us outside of your booked booth time. Booked time refers to active operating time, not setup or teardown.

7. Outdoor Events

We are happy to operate outdoors. For outdoor events the Client must provide a hard, level surface, and we recommend cover from sun, wind, and precipitation. We reserve the right to pause or discontinue Services if weather or conditions pose a risk to guests, staff, or equipment. No refund is due for time lost to unsafe conditions outside our control.

8. Delivery of Photos & Videos

For the 360 booth, videos may be shared with guests on-site by email or text. For Polaroid Event Photography, guests receive printed photos on-site, and the Client receives a digital gallery of the images after the event. We are not responsible for delivery failures caused by incorrect contact information provided by guests, or by venue internet or cellular limitations.

9. Guest Data Collection

Collecting guest information (such as names and emails) is available only as a requested add-on. Where the Client engages this option, the Client is responsible for informing its guests and for having an appropriate basis to collect and use that information. Our handling of personal information is described in our Privacy Policy.

10. Equipment & Damage

All equipment remains our property. The Client is responsible for loss of or damage to our equipment caused by the Client, its guests, or its agents beyond normal use, and agrees to reimburse the reasonable cost of repair or replacement.

11. Guest Conduct & Safety

Our staff may refuse or discontinue service to any individual behaving unsafely, abusively, or in a way that risks harm to people or equipment. The Client is responsible for the conduct of its guests. No refund is due for time lost to guest misconduct.

12. Photos, Video & Likeness

By participating in the Services, guests understand their image and likeness may be captured. We will display appropriate signage or notice at the activation where practical. The Client does not warrant that individual releases have been obtained from every guest. We will honor any restrictions the Client identifies in writing (for example, events involving minors, patients, students, or student-athletes).

13. Marketing & Portfolio Use

Unless the Client notifies us in writing before the event, we may use imagery of our own setup and general event activation, and reference the event, for portfolio, website, and social media promotion. Clients with privacy, confidentiality, or institutional requirements may opt out of some or all promotional use in writing before the event, and we will limit or omit that use as agreed. We will not use any Client's trademarks, logos, or protected marks without permission.

14. Limitation of Liability

Our total liability arising out of or relating to the Services, for any cause, shall not exceed the total amount actually paid by the Client for the specific booking. We are not liable for indirect, incidental, or consequential damages, including lost profits or opportunities. We are not responsible for failures or delays caused by factors outside our reasonable control, including venue limitations, power failures, or internet/cellular issues affecting digital sharing.

15. Indemnification

Each party is responsible for, and agrees to indemnify and hold harmless the other from, claims, damages, and costs (including reasonable attorney fees) arising from its own negligent or wrongful acts or omissions in connection with the event. Neither party is responsible for the negligence or misconduct of the other. Where the Client is a government entity or public institution that cannot legally indemnify a vendor, this Section applies only to the extent permitted by applicable law, and the parties may substitute the language that entity requires.

16. Insurance

We maintain commercial general liability insurance and can provide a Certificate of Insurance, including naming a venue or Client as an additional insured, upon reasonable advance request.

17. Force Majeure

Neither party is liable for failure or delay caused by events beyond its reasonable control, including acts of God, natural disaster, fire, flood, severe weather, epidemic or public health emergency, government order, power or utility failure, or venue closure. If such an event prevents the Services, the parties will work in good faith to reschedule; if rescheduling is not possible, amounts paid (other than the non-refundable deposit) will be refunded.

18. Independent Contractor

We provide the Services as an independent contractor. Nothing in these Terms creates an employment, partnership, or agency relationship between the parties.

19. Governing Law & Venue

These Terms are governed by the laws of the State of Idaho, without regard to conflict-of-law principles. Any dispute shall be brought in the state or federal courts located in Ada County, Idaho, and the parties consent to that jurisdiction and venue.

20. Entire Agreement, Modifications & Severability

These Terms, together with your booking or invoice, are the entire agreement between the parties regarding the Services and supersede prior understandings. Modifications must be in writing and agreed by both parties. If any provision is found unenforceable, the rest remain in effect. For corporate or institutional Clients, the parties may use the Client's own services contract or an addendum in place of or alongside these Terms; in the event of a conflict, the signed contract controls.
